TERMS AND CONDITIONS

1.     Purchase of the equipment offered by Seller constitutes Buyer’s acceptance of these Terms and Conditions which become a binding agreement between Seller and Buyer.

2.     No revisions to these Terms and Conditions are valid unless in writing and signed by an authorized representative of Seller, and no conditions stated by Buyer in making this purchase shall be binding upon Seller if in conflict with, inconsistent with, or in addition to these terms unless expressly accepted in writing by Seller.

3.     The shipping charge is inclusive of postage, shipping and handling fees, and the cost of packing materials.  Shipping charges listed are for within the continental U.S. only.  Shipping charges do not include taxes or demurrage charges, if any.  To receive tracking information regarding the shipment, Buyer must provide an email address.

4.     Foreign shipments, including Alaska and Hawaii, will be invoiced with appropriate shipping charges prior to any shipment.  Other fees may apply, including customs fees or duties.  A quote will be given for foreign shipments upon request, and fees must be paid before shipment.

5.     At Buyer’s request and expense, Seller will insure the shipment at the quoted rate through the shipping company.  Title and risk of loss transfers to Buyer upon shipment.

6.     The express warranties offered by Buyer are exclusive and in lieu of all other warranties related the product provided, whether such other warranties are written, oral or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.  All other warranties are expressly disclaimed.  

7.     The extent of liability of Seller for a breach of any warranty is limited to repair or correction of defects, the replacement of the defective equipment with a similar item free from the defect in question, or a refund of the original purchase price.  The choice to repair, replace, or refund shall be at the option of Seller, and shall be Buyer’s exclusive remedy for breach of warranty. 

8.      Seller shall not be liable for any special, indirect, incidental, or consequential damages or losses; any damages, costs or expenses in excess of the payment actually received by Seller from Buyer; or any claims, damages or losses to the extent arising out the negligence or misconduct of the Buyer, or the improper installation, misuse, or abuse of the product sold by Seller.

9.     Seller is committed to protecting the privacy and personally identifiable information of its Buyers.  Collected information is for internal use only and is never distributed or sold to third parties.
